The section “A pension claim” deals with Mrs Byrd, who wants to make an appointment at the law firm “Growers Legal Services Inc” to give her information’s about pensions rights of her work in Germany.
Mrs. Byrd was born on and raised in Haunstetten, a small town in Bavaria. She worked for six years in Augsburg in a big factory. Then she immigrates with her husband Paul, an America soldier, to the United States in 1968 and takes American citizenship. She has only been back to Germany once to visited Augsburg and her home town. She now comes up to retirement age (60) and estimate that she has some pensions rights in Germany, where she worked for a few years. So she contacts Growers Legal Services and wants to make an appointment, because she wants help to claim her pension’s rights in Germany.
Ms Carpenter, an advocate of the law firm, receives Mrs Byrd letter and invites her to come in for an interview above her maintenance history and some other personal information’s.
Shortly after Ms Carpenter telephones her contact the solicitor's office Braunsohle & Schmidt in Germany, and sends Mr Braunsohle a letter which contains some information about Mrs Byrd´s claim. Ms Carpenter also encloses copies of correspondence, including a letter sent by the pension authorities in Germany.
Two weeks later, Ms Carpenter receives a letter from Germany, which deals with the pension claim of Mrs Byrd. Mr Braunsohle discloses that he can file on behalf of Mrs Byrds and to represent her in court Munich against the Department of national Insurance, because it appears that Mrs Byrd has a claim for a pension shortfall. He adds a power of attorney form to the letter for the representing of Mrs Byrd and he also enlighten abut his attorney’s fees.
After that Mr Braunsohle sends Ms Carpenter a letter about the action he has taken. He informs her that he has filed a claim for Mrs Byrd as plaintiff against the state Social Insurance Board of Bavaria as defendant. She also imparts her that the case has gone in the first instance to the Social Court and that he thinks that it will be not complicated.
In the meantime Mrs Byrd gave up her job last month and has been out of work for the last few weeks. She phones Ms Carpenter to get some information and asks her how her case is progressing. Thereupon Ms Carpenter sends Mr Braunsohle an e-mail and she would like have some enquiries.
After the e-mail, Mr Braunsohle informs the client in the USA about the social courts decision in Germany. The Social court has detected that Mrs Brd will receive payments from the Bararina State Pension Fund, but the amount of thes payments will be determined in separate court.
